The Child’s Best Interests in Moroccan Law: A Legal Analysis of the Progress and Limitations of the Proposed Family Code Reform

This article provides a legal analysis of Morocco’s planned 2022 Family Code reform, focusing on its potential to strengthen the protection of children’s rights in line with the principle of the child’s best interests, as outlined in the International Convention on the Rights of the Child. While Morocco has incorporated this principle into its legal framework, notably through the 2011 Constitution and the 2004 Family Code, its practical implementation faces institutional and procedural challenges. By examining national laws, the observations of the Committee on the Rights of the Child, and recommendations from Moroccan institutions, the study assesses how the proposed changes could enhance children’s rights. It highlights the ongoing tensions between international legal standards and the traditional legal foundations of the Moroccan family structure. Ultimately, the article explores whether the reform can reconcile these contradictions, prioritize the child’s best interests in judicial and administrative policies, and introduce safeguards to strengthen children’s status within the national legal system.
